Terms of Use

These terms are an agreement between you and the developer of SwimTune (“SwimTune”, “we”, “us”) covering your use of the SwimTune iPhone and Apple Watch apps and related services (the “Service”). By downloading or using SwimTune, you accept these terms. If you do not accept them, do not use the Service.

1Who may use SwimTune

You must be at least 13 years old, or the minimum age required in your country, to use SwimTune. If you are under 18, you should review these terms with a parent or guardian.

2Your account

Some features require an account. You are responsible for the accuracy of the information you give us and for keeping your credentials secure. Tell us promptly if you believe your account has been used without your permission.

3Health and safety

Consult a qualified physician before beginning any training programme, particularly if you have a medical condition, are pregnant, are recovering from injury, or have not exercised recently. Stop immediately and seek medical attention if you feel unwell while training.

Swimming carries inherent risks, and open-water swimming carries greater ones. You are solely responsible for your own safety: swim within your ability, in supervised or appropriate conditions, and never rely on SwimTune to judge whether conditions are safe. Do not operate your device in a way that distracts you while swimming.

4AI-generated content

SwimTune uses artificial intelligence to generate training plans, coaching messages and other guidance. AI output can be inaccurate, incomplete, or unsuitable for your circumstances, and it is not reviewed by a human coach before you see it. Treat it as a suggestion to apply your own judgement to, not an instruction to follow blindly.

5Subscriptions and payment

SwimTune offers a free tier and an optional paid subscription, SwimTune Pro, which unlocks AI-powered features. Subscriptions are sold and managed by Apple through your Apple Account.

• Payment is charged to your Apple Account when you confirm the purchase.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of the period.
• Where a free trial is offered, any unused portion is forfeited if you buy a subscription during the trial.
• You can manage or cancel your subscription in your Apple Account settings. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple under its own policies. We cannot issue refunds for purchases made through the App Store.

Prices may change. Where a change affects an existing subscription, Apple will notify you and you may cancel before it takes effect.

6Your data

SwimTune processes the training and health data you choose to give it, including data you allow it to read from Apple Health. How we handle that data is described in our Privacy Policy, which forms part of these terms.

You keep ownership of your training data. You grant us only the permission needed to operate the Service for you: storing it, syncing it between your devices, and processing it to produce plans, analytics and coaching.

7Acceptable use

You agree not to:

• use the Service unlawfully, or to harm or harass anyone;
• attempt to gain unauthorised access to the Service, other users’ data, or our systems;
• circumvent, disable or interfere with subscription controls, usage limits or security features;
• copy, decompile, reverse-engineer or resell the Service except where the law expressly permits it;
• use automated means to extract data from the Service, or use it to build a competing product.

8Our intellectual property

SwimTune, its software, design, and content are owned by us or our licensors and protected by intellectual property law. These terms grant you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, as permitted by the App Store Terms of Service. They grant you no other rights.

9Availability and changes

We may change, suspend or discontinue any part of the Service. We aim to give reasonable notice of material changes, but the Service may also be unavailable without notice for maintenance, technical failure, or reasons outside our control. Features that depend on third-party services may change if those services do.

10Ending your use

You may stop using SwimTune at any time and delete your account from within the app. We may suspend or end your access if you breach these terms or if we are required to by law. Provisions that by their nature should survive termination, including sections 3, 4, 8, 11 and 12, will do so.

11Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we do not warrant that the Service will be uninterrupted, error-free, or that its output will be accurate or suitable for you.

12Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 50.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all rights granted to you by the mandatory consumer law of your country of residence.

13Apple

These terms are between you and us, not with Apple. Apple is not responsible for the Service or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service.

14Changes to these terms

We may update these terms. When we make material changes we will update the date above and, where appropriate, notify you in the app. Continuing to use the Service after a change means you accept the updated terms.

15Governing law

These terms are governed by the laws of Portugal, without regard to conflict-of-law rules. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and you keep the protection of its mandatory consumer law.
